Immigration, Refugees and Citizenship Canada (IRCC) has launched a new temporary policy to allow some Provincial Nominee Program (PNP) candidates to apply for an open work permit (OWP). This policy, effective from August 11, 2024, to December 31, 2024, aims to support eligible newcomers in their transition to permanent residency.
Under this policy, candidates with a job offer, a valid work permit, or a work permit that expired on or after May 7, 2024, can apply for an OWP. They must also have a support letter from their province or territory confirming their placement in an Expression of Interest pool or other application inventory process.
Eligibility Criteria
To qualify for the OWP under this new policy, candidates must meet specific conditions depending on their situation:
Scenario 1: Current Valid Work Permit
- Hold a valid work permit.
- Have submitted an application for a new work permit.
- Provide a support letter from the Provincial or Territorial authority confirming their placement in an Expression of Interest pool or application inventory.
- Include a letter of employment from their current employer.
Scenario 2: Expired Work Permit
- Held a valid work permit on May 7, 2024, which has since expired.
- Have applied for a new work permit and either an extension or restoration of temporary resident status.
- Provide a support letter from the Provincial or Territorial authority and a letter of employment from their current employer.
Scenario 3: Pending or Approved Work Permit Extension
- Authorized to work under paragraph 186 (u) of the regulations on May 7, 2024.
- Have an application for a new work permit and a pending or approved extension of temporary resident status.
- Provide a support letter from the Provincial or Territorial authority and a letter of employment from their current employer.
Objective of the Policy
IRCC's goal with this policy is to adjust the balance of temporary residents to permanent residents in Canada by facilitating the transition of eligible temporary residents through PNPs. The policy targets skilled workers who are already in Canada, have demonstrated their economic value, and have built community connections. By providing a clearer pathway to permanent residency, IRCC aims to retain these workers and address critical labor market needs.
