Want to Work in Canada While Waiting for PR? BOWP Can Keep You Working in Canada!

Bridging Open Work Permits (BOWPs) offer a valuable pathway for temporary workers in Canada to continue working while their permanent residence (PR) application is under process. This guide explains the key eligibility requirements, application steps, employment conditions, and options available if your current permit expires.

What is a Bridging Open Work Permit (BOWP)?

A BOWP allows eligible foreign nationals to continue working in Canada as they await a decision on their PR application. These permits are open work permits, meaning they are not tied to a specific employer or job, offering greater flexibility to work in most occupations across Canada.

  • Validity: BOWPs are usually issued for up to two years and may be extended at an officer’s discretion.
  • Freedom to Work: Unlike employer-specific permits, BOWPs provide freedom to work with any employer, though some location-based restrictions may apply depending on the program.

Who Can Apply for a BOWP?

To qualify for a BOWP, applicants must meet all of the following criteria:

  1. Reside in Canada on valid temporary resident status.
  2. Applied for permanent residence as a principal applicant under one of these programs:
    • Canadian Experience Class (Express Entry)
    • Federal Skilled Worker Program (Express Entry)
    • Federal Skilled Trades Program (Express Entry)
    • Provincial Nominee Program (PNP) – if nomination has no employer restrictions
    • Quebec Skilled Worker Program (QSW)
    • Agri-Food Pilot
    • Home Child-Care Provider Pilot or Home Support Worker Pilot
    • Caring for Children or People with High Medical Needs (submitted before June 18, 2019)
  3. Hold:
    • A valid work permit, OR
    • Maintained status (previously implied status) if applied for work permit renewal, OR
    • Eligible for restoration of status with authorization to work.
  4. Have received an Acknowledgement of Receipt (AOR) for their PR application.
  5. Completed the PR application stage, including a completeness check or positive eligibility assessment depending on the program.

Location-Based Work Conditions

While BOWPs allow employment with most employers, location restrictions apply to certain applicants:

  • Provincial Nominee Program (PNP): Work must be within the nominating province or territory.
  • Quebec Skilled Worker (QSW): Employment must be in Quebec.

How to Apply for a BOWP: Step-by-Step

Applying for a BOWP is primarily done online via IRCC's official portal. Here's how to proceed:

  1. Check eligibility based on the above criteria.
  2. Choose “Open Work Permit” as the type on the IRCC portal.
  3. Complete all required application forms.
  4. Upload supporting documents based on your immigration stream.
  5. Pay applicable fees, including processing and OWP holder fees.
  6. Submit the application.

Validity Period:

  • A BOWP is valid until a PR decision is made, or up to 24 months, or until the applicant’s passport expires—whichever comes first.
  • If additional time is needed, IRCC may extend a BOWP up to 12 months.

What If Your Work Permit Expires Before Applying for a BOWP?

If your work permit has expired and you haven't applied for a BOWP, you cannot legally work unless you have maintained status or can restore your status. Options include:

  1. Apply for a visitor record to remain in Canada temporarily without working.
  2. Leave Canada and await PR decision from outside.
  3. Apply for a new work permit under the Temporary Foreign Worker Program (TFWP) with an LMIA-backed job offer.

Can Family Members Apply for an Open Work Permit (OWP)?

Yes, spouses, partners, and dependent children may be eligible for an OWP if certain conditions are met.

Principal Applicant's Requirements:

  • Currently working and residing in Canada.
  • Hold a valid work permit (or approved for one).
  • Work permit valid for at least six months beyond the family member’s OWP application date.
  • Applied for PR under an economic pathway.
  • If under QSW, hold a Certificat de sélection du Québec.
  • Occupation in NOC TEER 0, 1, or select TEER 2 and 3 roles.

Family Member's Requirements:

  • Meet general eligibility for work permit issuance.
  • Maintain temporary resident status, have maintained status, or be eligible to restore status.
  • Be in a genuine relationship (spouse, partner, dependent child, grandchild).

Important Reminders for BOWP Applicants

  • Work under maintained status is allowed if a BOWP application was submitted before current permit expiry.
  • If outside Canada when the work permit expires, you cannot work until BOWP approval.
  • Processing time typically ranges from 3 to 4 months.
