Immigration, Refugees, and Citizenship Canada (IRCC) has unveiled a new policy aimed at simplifying the process for foreign workers in Canada to obtain an Open Work Permit (OWP). This initiative is specifically for individuals who have submitted an Expression of Interest (EOI) under a Provincial Nominee Program (PNP). The policy is effective until December 31, 2024, offering successful applicants a work permit valid for up to two years.

Eligibility Criteria

To apply for an OWP under this policy, applicants must meet the following conditions:

  1. Work Permit Status:

    • Hold a valid work permit.
    • Have an expired work permit after May 7, 2024, with a restoration application submitted.
    • Have a pending or approved extension for their current work permit.
  2. Required Documentation:

    • A letter of employment from a current employer located in Alberta, Manitoba, or Yukon.
    • An OWP support letter issued by the provincial or territorial government confirming their placement in an EOI pool or PNP.

Application Process and Conditions

  1. Residency Requirements:
    Applicants must remain in Canada during the application review process to maintain temporary resident status. Leaving Canada before a decision is made will void their status and require reapplication.

  2. Submission Guidelines:
    Applications must be submitted online. In-person submissions, including those at the border, are not permitted.

Documents Checklist

Applicants should prepare the following documents for submission:

  • Passport ID page (valid and legible).
  • Digital photo (taken within the past six months).
  • Support letter from the provincial or territorial government.
  • Copy of current or expired work permit.
  • Letter from current employer.
    Additional documentation may be required, tailored to each applicant’s individual circumstances.

Permit Validity and Associated Costs

  • Validity: If approved, the OWP will be valid for up to two years or until the passport expires, whichever comes first.
  • Fees:
    • Work Permit Application: $155
    • Restoration of Status (if applicable): $229
    • Biometrics (if required): $85

Family Benefits

Approved applicants’ spouses or common-law partners may also apply for an open work permit. Dependent children (kindergarten through Grade 12) can either:

  • Apply for a study permit, or
  • Attend school without a permit if already residing in Canada.
